1. Acceptance of Terms
By accessing the online services of Infinity Cooperative Housing Society Ltd. (“Society,” “we,” “us,” “our”), every member (“you,” “Member”) agrees to be bound by these Terms and Conditions, the registered Model Bye-laws, and the Maharashtra Co-operative Societies Act, 1960 (“MCSA”) together with the Maharashtra Co-operative Societies Rules, 1961.
2. Scope
These Terms govern (i) the generation, presentation, and payment of periodic maintenance invoices, (ii) voluntary contributions toward cultural or welfare activities, and (iii) any other digital facility offered on https://www.infinitychs.in (“Portal”).
3. Maintenance Charges
a. Levy: Charges are raised in accordance with Bye-law No. 65-71 and Section 154B-29 of the MCSA.
b. Due Date: Invoices fall due 45 days from the date of electronic issuance.
c. Mode: Payments must be made through the secure payment gateway integrated into the Portal or MyGate App.
d. Interest & Penalties: Arrears attract interest up to 21% p.a., or the rate fixed by the General Body, from the due date until full realisation.
e. Restriction of Privileges: Persistent default empowers the Managing Committee to suspend access to common amenities and to proceed under Section 154B-29 for recovery, including attachment of the unit.
4. Donations
Voluntary donations for cultural or community welfare events are accepted online. Donations are non-refundable and will be utilised strictly for the stated purpose, with utilisation statements tabled in society notices.
5. Use of the Portal
Members shall not:
upload false information, defamatory or illegal content;
attempt unauthorised access, introduce malware or interfere with Society systems.
The Society may suspend or terminate access without notice for any violation.
6. Limitation of Liability
Services are provided “as-is.” The Society, its Committee, employees and service providers shall not be liable for indirect, incidental or consequential damages arising out of Portal use or payment processing, except for wilful misconduct or gross negligence, subject to applicable law.
7. Dispute Resolution
Disputes relating to maintenance charges shall first be submitted in writing to the Society’s Grievance Redressal Officer. Failing amicable resolution within 30 days, parties may approach the Registrar Co-operative Societies or the Co-operative Court as provided under the MCSA.
8. Governing Law & Jurisdiction
These Terms are governed by the laws of India and the courts and Co-operative authorities situated at Pune, Maharashtra have exclusive jurisdiction.
